Terms of Service

These terms govern all web design and development projects undertaken by createwebsite.my.id ("I", "me"). By proceeding with a project after receiving a quote, you ("Client") agree to these terms.

1. Project agreement

Each project begins with a written quote sent via email. The quote specifies the scope, price, timeline, and number of revision rounds included. The project is considered agreed when the Client confirms the quote in writing and pays the deposit. Verbal agreements are not binding.

2. Payment

Payment is split as follows: 50% deposit before work begins, 50% on delivery before the site goes live or files are handed over.

Payment is accepted via bank transfer or PayPal. Invoices are in USD unless otherwise agreed. The deposit is non-refundable if the Client cancels after work has started. If I cancel, the deposit is refunded in full.

If the final payment is not received within 14 days of the delivery notification, I reserve the right to take the site offline until payment is settled.

3. Scope and changes

The quote covers what is described in writing. Any additions to scope after the project starts will be quoted separately and billed at my current hourly rate before the additional work begins.

If the Client's requirements change substantially from what was originally described, I may revise the quote. I will communicate this before continuing.

4. Revisions

Each project includes two rounds of revisions at the design stage and one round at the build stage, unless stated otherwise in the quote. A revision round means collecting all feedback at once and addressing it in a single pass. Feedback sent piecemeal across multiple messages counts as multiple rounds.

Additional revision rounds beyond what is included are billed at my current hourly rate.

5. Timeline

The timeline stated in the quote assumes timely feedback from the Client. If feedback is delayed more than five business days at any stage, the timeline shifts forward by the number of days delayed. I will notify the Client of any timeline changes.

Rush delivery (faster than the standard timeline) may be available at an additional cost, to be agreed in writing before work begins.

6. Client responsibilities

The Client is responsible for providing:

  • All written content (text) in its final form before the build stage
  • All images and other media in appropriate resolution
  • Brand assets (logo files, color codes, fonts) if applicable
  • Access to any third-party accounts needed (domain registrar, CMS, etc.)
  • Timely feedback at each review stage

If content or assets are not provided within seven business days of being requested, I may use placeholder content to keep the project on schedule. Replacing placeholder content after the build stage is billed at my hourly rate.

7. Intellectual property

Upon receipt of final payment, the Client receives full ownership of all custom design and code produced for the project. I retain the right to display the work in my portfolio unless the Client requests otherwise in writing.

Third-party assets (fonts, stock images, libraries) remain subject to their own licenses. The Client is responsible for ensuring they have the rights to any content they provide.

8. Hosting and maintenance

I do not provide ongoing hosting as part of the project fee. The site will be deployed to a platform agreed with the Client (typically Cloudflare Pages). Ongoing hosting fees, if any, are the Client's responsibility.

Post-launch maintenance is not included. If the Client requires updates after launch, these are billed at my current hourly rate.

9. Liability

I will do my best to ensure the site is functional, performant, and free of errors. However, I cannot guarantee uptime, security of third-party services, or compatibility with all browsers and devices in perpetuity.

My total liability for any claim arising from a project is limited to the amount paid for that project. I am not liable for any indirect or consequential losses.

10. Governing law

These terms are governed by the laws of Indonesia. Any disputes will be resolved first by negotiation in good faith. If negotiation fails, disputes will be subject to the jurisdiction of the courts of Jakarta, Indonesia.

11. Changes to these terms

These terms may be updated from time to time. The version in effect at the time a project is agreed governs that project. Future projects use the then-current terms.
